1. Acceptance of Terms

By accessing, browsing, or using the Website in any manner, including registering an account, adding items to your cart, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations of India. These Terms constitute a legally binding agreement between you and Uwald Creation.

2. Definitions

• "Products" means the apparel and accessories listed for sale on the Website.
• "Order" means a request placed by you to purchase Products through the Website.
• "Account" means the registered user profile created to place Orders and track order history.
• "Content" means text, graphics, logos, images, product descriptions, and other material appearing on the Website.

3. Eligibility

The Website and its Products are intended for use by individuals who are at least 18 years of age and competent to enter into a binding contract under the Indian Contract Act, 1872. Uwald Creation sells children's clothing, but all Orders must be placed by a parent, legal guardian, or other adult on behalf of the child. If you are under 18, you may use the Website only under the supervision of a parent or legal guardian who agrees to these Terms.

4. Account Registration & Security

To place an Order you must create an Account by providing accurate, current, and complete information, including your name, email address, and phone number. You agree to:

• Keep your login credentials confidential and not share them with any third party
• Notify us immediately at legal@uwaldcreation.in of any unauthorised use of your Account
• Accept responsibility for all activity that occurs under your Account
• Update your Account information promptly if it changes

We reserve the right to suspend or terminate any Account that provides false information or is used in violation of these Terms.

5. Products, Pricing & Availability

• All prices displayed on the Website are in Indian Rupees (₹) and are inclusive of applicable taxes, unless stated otherwise.
• We make reasonable efforts to display Product colours, sizes, and details accurately; however, slight variations may occur due to photography, lighting, or display/monitor settings, and do not constitute a defect.
• Product availability and stock levels are subject to change without notice. Listing a Product on the Website does not guarantee its availability at the time of Order.
• We reserve the right to modify, discontinue, or correct pricing errors for any Product at any time, including after an Order has been placed, in which case we will notify you before processing.

6. Placing an Order

An Order is placed once you complete checkout with a valid, persisted delivery address and a successful payment method (prepaid via Razorpay or Cash on Delivery). Placing an Order is an offer by you to purchase the selected Products, which we may accept or decline. An Order is confirmed only after (a) payment is successfully verified for prepaid Orders, or (b) the Order is placed for Cash on Delivery. You will receive an email/SMS confirmation once your Order is confirmed.

7. Order Cancellation

We reserve the right to cancel any Order, in whole or in part, at any stage prior to shipment, for reasons including but not limited to:

• Unavailability of stock or discontinuation of a Product
• Inaccuracies or errors in pricing or Product information
• Suspected fraudulent, unauthorised, or abusive activity
• Inability to deliver to the address provided, or failed Cash on Delivery verification

If we cancel a prepaid Order, the full amount paid will be refunded to the original payment method within 5–7 business days. You may cancel an Order yourself only while it is in the "New" status, before it has been accepted for processing; once accepted, cancellation is handled per our Return Policy.

8. Payments

• We accept prepaid payments via Razorpay (cards, UPI, net banking, wallets) and Cash on Delivery (COD), where available for your pin code.
• Prepaid transactions are processed and secured by Razorpay. We do not store your card, UPI, or net-banking credentials on our servers.
• For prepaid Orders, payment is verified server-side before an Order is created; the amount charged is always validated against our records, never taken from client-submitted values.
• COD Orders may attract an additional handling charge as disclosed at checkout and in our Shipping Policy.
• In case of a payment failure after debit, any amount deducted will be automatically reversed by your bank or payment provider within their standard timelines; contact us if a reversal does not reflect within 7 business days.

9. Shipping & Delivery

Orders are shipped pan-India through our courier partners. Estimated delivery timelines, shipping charges, and tracking details are described in our Shipping Policy, which forms part of these Terms. Delivery timelines are estimates and not guaranteed; we are not liable for delays caused by courier partners, weather, regulatory action, or other circumstances beyond our reasonable control.

10. Returns, Refunds & Exchanges

Returns, exchanges, and refunds are governed by our Return Policy, which forms part of these Terms. Please review it for eligibility windows, non-returnable categories, and the refund process.

11. Website Use & Prohibited Conduct

You agree to use the Website only for lawful purposes. You must not:

• Violate any applicable law, regulation, or third-party right
• Transmit unsolicited commercial communications, spam, or malware
• Attempt to probe, scan, or test the vulnerability of the Website or circumvent its security or authentication measures
• Use any automated system (bot, scraper, crawler) to access the Website without our prior written consent
• Reproduce, duplicate, copy, sell, resell, or exploit any part of the Website or its Content for commercial purposes without our permission
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Submit false, fraudulent, or abusive Orders, reviews, or testimonials

12. Intellectual Property

All Content on the Website, including the "Uwald Creation" name and logo, text, graphics, product photography, and page layout, is the property of Uwald Creation Fashion or its licensors and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws. You may view and download Content for personal, non-commercial use only. No right, title, or interest in any Content is transferred to you, and you may not reproduce, distribute, modify, or create derivative works from it without our prior written permission.

13. Third-Party Links & Services

The Website may integrate with or link to third-party services (including Razorpay for payments, and our courier and logistics partners). We do not control and are not responsible for the content, policies, or practices of any third-party service. Your use of such services is subject to their respective terms and privacy policies.

14. Disclaimer of Warranties

The Website and Products are provided on an "as is" and "as available" basis. While we take reasonable care in curating and describing our Products, we do not warrant that the Website will be uninterrupted, error-free, or free of viruses or other harmful components. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose, other than those which cannot be excluded under the Consumer Protection Act, 2019.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Uwald Creation shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Website or Products. Our aggregate liability arising from any Order shall not exceed the total amount paid by you for that Order. Nothing in these Terms limits any liability that cannot be excluded under Indian law, including under the Consumer Protection Act, 2019.

16. Indemnification

You agree to indemnify and hold harmless Uwald Creation, its officers, employees, and partners from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, misuse of the Website, or violation of any law or third-party right.

17. Force Majeure

We shall not be held responsible for any delay or failure to perform an obligation under these Terms where such delay or failure arises from causes beyond our reasonable control, including natural disasters, strikes, courier or transport disruptions, government restrictions, or failures of internet, payment gateway, or telecommunications infrastructure.

18. Suspension & Termination

We may suspend or terminate your Account and access to the Website, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or misused the Website. You may stop using the Website and request deletion of your Account at any time by contacting us as described in Section 22.

19. Grievance Redressal

In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, the details of our Grievance Officer are provided below. If you have any complaint or concern regarding an Order, Product, or use of the Website, please write to our Grievance Officer, who will acknowledge your complaint within 48 hours and endeavour to resolve it within one month from the date of receipt.

20. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Subject to the grievance redressal mechanism above, any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Surat, Gujarat, without prejudice to any right you may have to approach a consumer forum or commission having jurisdiction under the Consumer Protection Act, 2019.

21. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or applicable law. The "Last updated" date at the top of this page indicates when these Terms were last revised. Continued use of the Website after any change constitutes your acceptance of the revised Terms.
